The Best Mediums Privacy Notice sets out how we collect and process your data when you use our services and website, please read this notice in conjunction with our Terms & Conditions, so that you can make an informed decision as to whether you want to consent to and comply with these policies.

The UK General Data Protection Regulations (UK GDPR) became effective on the 31st December 2020 and is tailored by the Data Protection Act 2018. The EU Exit Regulations applied technical amendments to make the GDPR work in a UK context, but the principles and rules are essentially unchanged. The Privacy and Electronic Communications (EC Directive) Regulations 2003 (PECR) is unchanged aside from references within it to the GDPR are now to the UK GDPR. It is possible due to changes in our operations or alterations to the law, that we may from time to time need to make changes to the privacy notice. This will be signified by a change to the date at the top of the notice. Please visit this page often so you are aware of any changes that have been made.

What data is being collected?

The data we collect depends on the service that you use, but generally is considered information that is personally identifiable, including but not limited to the following:

  • Name, Address, Email Address and Telephone Number(s).
  • Credit/Debit card info (collected and processed by 3rd party providers).
  • Date of birth and/or age.
  • Customer Comments that you have left for readers and given us permission to publish.
  • Complaints or communications by phone, by email or by post or via our website forms.
  • Telephone recordings.
  • Transcripts of questions/answers for text & chat readings.
  • Paper or computer documentation, that you have submitted or has been written by way of transposing a communication of some type.
  • Social media posting/comments/communications that you have left on or via our sites.
  • IP Address, and your browsing behaviours – please see ‘cookies’ information below.

Cookies – what are they and how do we use them?

This website may use cookies which are small text files that are placed on your machine to help the site provide a better user experience. In general, cookies are used to retain user preferences and provide anonymised tracking data to third party applications like Google Analytics. As a rule, cookies will make your browsing experience better. However, you may prefer to disable cookies via your browser.

How do we use the data?

To provide, maintain and improve the Best Mediums brand, services and corresponding website.

To deliver Best Mediums services and provide/send to you any relevant information as required by that service.

We may contact you regarding a service that you have enquired about, purchased or requested.

We will respond to your comments, questions or requests by way of customer service across all platforms you may use.

If asked by a regulator we will comply with their requirements to provide data.

We may monitor calls to investigate any complaints.

We will investigate any fraudulent transactions or illegal activities and pass this information on to the appropriate company/authorities.

If you have consented to marketing we may send you our newsletter, updates about changes in legislation or delivery of our products, new or improved services we are offering and special offers.

The Best Mediums website may include web address links to other sites. If you click on such a link, you are then leaving the Best Mediums website and this privacy notice will no longer apply. You will be responsible for checking the privacy notice, security and content of any sites that you visit, to determine how your data will be treated by that company and whether you wish to continue on that basis.

Children’s Privacy:

Best Mediums does not provide services to anyone under the age of 18, and as such the website, social media, marketing and digital advertising has been structured as such to not attract anyone under that age.

Marketing:

If you have subscribed and consented to receive marketing materials by post or email through one of our websites or via our services, then you may be receiving monthly communications from us concerning special offers, changes to our services or our newsletter by post or by email.

We want to ensure that it is as straightforward for you as possible to change your marketing preferences and unsubscribe should you wish to. So, if you wish to amend your address details, change from postal to email marketing or unsubscribe completely, the quickest way to do that is to email us providing the relevant information to: [email protected]

If you would like to view the content of the newsletter, but do not wish to subscribe to have it sent to you direct you can download it from the website whenever you want.

What is the legal basis for processing the data?

We rely on several lawful bases for processing your personal data, depending on the context of our interaction with you.

Contract:

When you purchase or request one of our services, we process your personal information under the lawful basis of Contract.

This means that the processing is necessary to:

-Provide and deliver the service you have requested (for example, a telephone, email, chat, or text reading).

-Process payments and maintain records relating to those transactions.

-Communicate with you about the service you have purchased or enquired about (including confirmations, customer support, or complaint handling).

-Meet regulatory and compliance obligations relevant to our services (e.g. Ofcom requirements).

Without this information, we would be unable to fulfil the service you have requested or maintain appropriate records of our interactions.

Legitimate Interests:

In certain situations, we process your personal data under the lawful basis of Legitimate Interests.

We have carefully assessed our use of Legitimate Interests through an internal Legitimate Interests Assessment (LIA) to ensure our interests are balanced with your rights and freedoms.

Purpose of processing under Legitimate Interests:

We may contact existing or recent customers about services and offers similar to those they have previously used, including:

-Sending our printed magazine by post (usually once per month).

-Sending occasional promotional or informational emails (usually two per month).

-Sending promotional or service-related text messages (with no fixed schedule).

Why we rely on Legitimate Interests:

You have an existing relationship with Best Mediums, and our communications relate only to services that are relevant to you.

We believe you would reasonably expect to hear from us about similar services, updates, or offers.

You always have the right to object or opt out at any time.

Safeguards in place:

We never sell your data to third parties or share it for external marketing purposes.

All marketing communications include a clear unsubscribe option.

You can request to stop receiving marketing at any time by emailing [email protected] or by following the opt-out instructions included in any message.

Suppression lists are maintained to ensure you are not contacted again if you unsubscribe.

Consent:

In some cases, we rely on Consent to process your personal data for marketing purposes.

This applies where you have positively opted in — for example:

-Entering a prize draw and choosing to receive marketing communications.

-Signing up for our newsletter directly through our website.

Legal Obligation:

In some instances, we are required to retain or share information to comply with a legal or regulatory obligation — for example, if requested by Ofcom or another authority.

Will the data be shared with any third parties?

We want to reassure you that we take the processing and handling of your data very seriously. We do not and never will sell your data to a third party or allow any third party access to your data for marketing purposes.

We do use some external companies to assist in processing our services, and it may be necessary at times to share your data with them, for example, telecoms facilities, credit card processing, postal delivery, email distribution, text & chat reading delivery etc in order to provide you with the service you have requested.

Psychic Bureaus that utilise the services of Bureau Telecoms.

Contractors such as email readers who are restricted to the information you have supplied to enable them to do the reading.

Service Provider: Allstar Psychics Ltd. Who facilitate our Text and Chat services and the Pre-Pay wallet system.

Ofcom in the UK – Regulatory body (Only if requested and required by law).

How long will the information be used/stored for?

We will only retain information or data for the length of time that is necessary for the purpose of our transaction with you, as required by any regulating bodies or for the reasons set out in this privacy notice.

Clients may contact us, to ask ‘to be forgotten’, whereby we will delete contact details, call lists and card details for example. Ofcom requires that we retain call recordings for 2 years, we have adopted these timescales, as best practice across our business for all recordings; they are routinely deleted on a rolling basis. Certain aspects of your data will need to be retained on our systems, in case it is required in the future to query any billing or fraudulent event. Any information retained is for your/our protection, and this will be discussed with you, should you make such a request.

If you have opted-in to receive marketing materials from us, we will continue to send to you until such time as you change your preferences or unsubscribe, or we deem a suitable amount of time has passed since you last used our service and consider that you are no longer interested.

If you use our debit/credit card services either via our Reception team or our Pre-Pay service, then your card details will be stored for your convenience, so you can use on future calls (unless you request otherwise). The card will remain on the system until the expiry dates have ended or you have not used the service in 6 months. When you use a debit or credit card to purchase any service (Telephone, Pre-Pay or Chat Readings) – your card details are not processed or stored by Best Mediums; they are processed by; third-party providers who is PCI compliant.
